Topic: Employment Law: Sexual Harassment in the Workplace

This presentation will cover topics related to sexual harassment in the workplace. Given the recent #metoo movement and the increased attention on the issue of sexual harassment in the workplace, it is important for employers to know what behaviours to look for and how to proceed if there is an issue. This presentation will cover the following: How to identify problematic behaviour, including examples from case law; How sexual harassment differs from other harassment; best practices when you receive an internal complaint; what to do if you are faced with a complaint at the Human Rights Tribunal or a lawsuit in Court; The types of damages that Courts have awarded; and prevention and policies to have in the workplace.

 

Guest speakers: Mr. David Contant and Ms. Alison McEwen, Nelligan O’Brien Payne LLP

 

David is a partner at Nelligan O’Brien Payne LLP, and is certified by the Law Society of Upper Canada as a Specialist in Civil Litigation. 

David has significant experience in commercial disputes, including real property litigation, contract disputes, intellectual property matters, collections, and defamation. David’s commercial litigation experience extends to construction law matters where he has acted on behalf of owners, general contractors, and subcontractors. David is currently the Co-Director of Research for the firm, assisting all lawyers, consultants and students with legal research.

 

Alison received her J.D. from the University of British Columbia in Vancouver. During law school, Alison was a clinician and then later a clinic head at the Law Students’ Legal Advice Program, which offers legal service to low income clients. She also completed a role as the coordinator of the Pro Bono Students Canada program at UBC. During all three years of law school Alison was heavily involved in the UBC Law Careers Committee.Prior to being called to the Ontario bar, Alison spent a year as a judicial law clerk with the judges of the East Region of the Superior Court of Justice. She also completed her articles at Nelligan O’Brien Payne.
